Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Vita Wellness website at vitawellness.space and the Vita Wellness cloud service, including the web application, desktop software and program library (together, the “Service”). The Service is provided by Vita Wellness (“Vita Wellness”, “we”, “us”, “our”).

By creating an account, purchasing a subscription or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. About the Service

Vita Wellness is a cloud service that lets owners of compatible frequency-based wellness devices browse a library of programs, create custom sets, write programs to their devices, keep a writing history and sync their data across computers. Depending on the plan, the Service may also include a specialist workspace for managing client profiles and session history.

2. Important notice: not a medical service

The Service is intended to support general well-being and self-care only.

• The Service is not a medical device, medical service or healthcare product.
• The Service is not intended to diagnose, treat, cure, mitigate or prevent any disease or medical condition.
• Information in the Service, including program names and descriptions, is provided for general wellness purposes and is not medical advice.
• Always consult a qualified healthcare professional regarding any health concern. Do not disregard or delay seeking professional medical advice because of anything in the Service.

Vita Wellness does not manufacture or sell the devices used with the Service. You are responsible for using your device in accordance with its manufacturer’s instructions, safety warnings and contraindications.

3. Eligibility and accounts

You must be at least 18 years old and able to enter into a binding contract to use the Service. You agree to provide accurate account information and to keep your login credentials confidential. You are responsible for all activity under your account. Notify us immediately at support@vitawellness.space if you suspect unauthorized access.

4. Plans and pricing

The Service is offered on a subscription basis. Current plans are:

• Lite includes access to the cloud program library, ready-made and custom sets, writing to compatible devices, writing history, sync across computers, updates and email support.
• Pro includes everything in Lite plus access to every section of the Service, including the specialist workspace.

Prices are shown in euros (EUR) and exclude VAT and other applicable taxes, which are calculated and added at checkout based on your country. The current plan contents and prices are always shown on vitawellness.space. We may change prices for future billing periods; we will notify you by email at least 14 days before a price change takes effect for your subscription, and you may cancel before it applies.

5. Payment and billing

Payments are processed by our authorized third-party payment provider, which may act as the reseller or merchant of record for your purchase. In that case, the payment provider’s name may appear on your card statement and the provider’s terms of sale also apply to the transaction. We do not store your full payment card details.

By subscribing, you authorize the payment provider to charge your selected payment method for the subscription fee and applicable taxes at the start of each billing period.

6. Automatic renewal and cancellation

Subscriptions renew automatically at the end of each billing period (monthly or yearly) at the then-current price, unless cancelled. You can cancel at any time in your account. After cancellation, your subscription will not renew and you keep access until the end of the period you have already paid for.

7. Upgrades and downgrades

You can upgrade from Lite to Pro at any time. The upgrade takes effect immediately; the amount charged for the upgrade is shown at checkout before you confirm. Downgrades from Pro to Lite take effect from the next billing period.

8. Refunds

Refunds are governed by our Refund & Cancellation Policy, which forms part of these Terms.

9. Device compatibility

The Service works with devices from different manufacturers. A list of supported devices or device families is available in the Service or on request. We do not guarantee compatibility with every device model or firmware version. Check compatibility before purchasing; if you cannot connect a supported device, contact support@vitawellness.space.

10. Acceptable use

You agree not to:

• copy, resell, sublicense or redistribute the program library or any part of the Service;
• share your account with others or use one account on behalf of multiple unrelated users, except through the features provided in the Pro plan;
• reverse engineer, decompile or attempt to extract the source code of the Service, except where permitted by law;
• interfere with or disrupt the Service, its security or its infrastructure;
• use the Service to make medical claims to third parties, or to present the Service as a medical device or medical treatment;
• use the Service in violation of any applicable law.

11. Specialist use (Pro plan)

If you use the specialist workspace to store information about your own clients, you are responsible for obtaining any consents and having a lawful basis for processing their data, for informing them that the Service is a wellness tool and not a medical service, and for complying with professional and legal requirements that apply to you. With respect to your clients’ data, we act on your instructions as described in our Privacy Policy.

12. Intellectual property

The Service, including the software, program library, texts, design and trademarks, is owned by or licensed to Vita Wellness and is protected by intellectual property laws. Subject to these Terms and payment of applicable fees, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for its intended purpose during your subscription. Custom sets and data you create remain yours.

13. Availability and changes

We work to keep the Service available and up to date, but we do not guarantee uninterrupted or error-free operation. We may carry out maintenance, update the program library and modify or discontinue features. If we make a change that materially reduces the core functionality of your plan, we will notify you and you may cancel.

14. Suspension and termination

We may suspend or terminate your access if you materially breach these Terms, fail to pay fees when due, or use the Service in a way that creates legal risk or harm to us or others. You may stop using the Service and delete your account at any time.

15. Disclaimer of warranties

To the maximum extent permitted by law, the Service is provided “as is” and “as available”. We make no warranties, express or implied, regarding any health, wellness or other outcome from using the Service or any device.

16. Limitation of liability

To the maximum extent permitted by law, Vita Wellness will not be liable for any indirect, incidental, special, consequential or punitive damages, or for loss of data, profits or revenue. Our total liability for any claim relating to the Service is limited to the amount you paid us for the Service in the 12 months before the event giving rise to the claim. Nothing in these Terms limits liability that cannot be limited under applicable law, or your statutory rights as a consumer.

17. Governing law and disputes

These Terms are governed by the laws of the jurisdiction in which Vita Wellness is registered, without regard to conflict-of-law rules. If you are a consumer, you also benefit from any mandatory protections of the law of your country of residence. Before starting formal proceedings, please contact us at support@vitawellness.space so we can try to resolve the issue informally.

18. Changes to these Terms

We may update these Terms from time to time. We will post the updated version on vitawellness.space and update the date above. For material changes, we will notify you by email or in the Service. Continued use after the changes take effect means you accept the updated Terms.
